Lawsuit Challenges APHIS Final Rule on Agriculture Biotechnology

On July 26, six non-governmental organizations filed suit against the 2019 USDA Final Rule that modernized the Department’s biotechnology regulation (SECURE rule). The plaintiffs are the Center for Food Safety, the National Family Farm Coalition, Pesticide Action Network North America, Center for Environmental Health, Friends of the Earth, and Center for Biological Diversity. The lawsuit alleges the final rule is not in compliance with the Administrative Procedures Act, Endangered Species Act, the National Environmental Policy Act, and the Plant Protection Act.
